San Diego, CA  –  Capping off a record 2016 for TargetCW, Dave Bakkeby has joined the company to lead the growth of national and global accounts. Dave’s experience spans nearly 20 years in the recruiting industry as a business development leader.

He spent over 18 years in business development with Orion International, a leading provider of best-in-class Military Talent Programs, where he designed and implemented Strategic Military Talent Programs. He then became SVP of Business Development at Novotus, a leading provider of Recruitment Process Outsourcing (RPO) and Recruiting Services, after it was acquired by Orion International. Prior to his tenure at Orion International, Dave spent 6 years as a Captain in the United States Marine Corps, for which we are grateful for his service.

Dave joins TargetCW at the end of a record revenue year as the Senior Vice President of Business Development to build upon the company’s success providing contingent workforce solutions to a growing number of top companies in the United States and Europe.

California Paid Sick Leave Effective July 1st

What you need to know…

The state of California passed legislation that allows employees to accrue paid sick leave beginning Wednesday, July 1st 2015. To learn more about the new legislation, visit the state’s industrial website at http://www.dir.ca.gov/ 

Who’s eligible for paid sick leave?

Beginning July 1, 2015, employees working 30 or more days within a calendar year in the state of California will begin to accrue paid sick leave. 

Who’s NOT eligible for paid sick leave?

Employees covered by qualifying collective bargaining agreements, In-Home Supportive Services providers, and certain employees of air carriers in the state of California are not covered by this law. 

Other important information:

  • Employees hired after July 1st will begin accruing paid sick leave on their first day.
  • Employees will be eligible to use sick time after 90 days of employment.
  • Employees will accrue 1 hour of paid sick leave for every 30 hours worked, but may only use 3 days (24 hours) per calendar year.
  • Unused sick leave may be “rolled over” to the next calendar year, however the accrual amount is capped at 48 hours.
  • To be paid for sick leave, TargetCW employees simply add another “timecard” in webcenter, their online time keeping tool. If hours are submitted in a different manner, please check with your onsite provider.
  • Accrued sick leave will be reported to TargetCW employees via pay stubs.
  • Certain cities in California are subject to more generous sick leave policies. Employees working in San Francisco and Oakland, or if your assignment provides a more generous sick leave policy, this new law does not restrict ordinances or policies.

TargetCW opened its doors with a small handful of clients. 5 years later, we’re blessed that so many clients and employees have made TargetCW a part of their daily professional lives.

ACA Regulations & 1099 Classification: Are You Compliant?

Don’t Ignore the Warning Signs!

Two of the most critical components of managing a workforce are compliance with the Affordable Care Act legislation (ACA or Obamacare) and Independent Contractor classification (1099). Employers are bombarded with information about the failure to comply because of the risk of penalty and heavy taxation. For many businesses, it’s not just the penalties that are a concern, but all the time and effort that goes into complying with an audit.


ACA Compliance Is Not Just For Staffing Agencies!

A major provision of the ACA legislation known as “shared responsibility” (26 U.S.Code §4980H) states that “common law” employers are liable if a temporary agency does not comply with the ACA. Employers with over 50 full time employees, working at least 30 hours per week, must offer affordable insurance that provides minimum coverage, and/or that employees must seek to obtain at least the minimum coverage. If you have more than 50 employees and your agency does not provide ACA coverage, your business will be held liable and will face a penalty. Agencies must offer coverage that does not exceed the 9.5% income threshold, and they must contribute 60% of the cost of premiums. Assuming that you’re agency has it covered could mean significant loss in revenue. As an employer, you need to make sure your agency has their compliance program together. A few things to look for: address the shared responsibility provision, including the language in the contract/addendum to address any possible issues, indemnification in case of an audit and clearly written expectations around all the variables in the ACA, including the cost.


Classifying 1099s Is A Greater Risk than Ever

A big focus for employers hiring Independent Contractors is classifying their status correctly. Businesses typically save money hiring ICs because they avoid paying federal and state taxes, insurance and administrative overhead. However; if employers misclassify a worker(s) major penalties will be levied on both federal and state levels, not to mention workers compensation revisions etc. The risk is now amplified because of the ACA legislation. For example; if an IC working on a yearlong contract becomes ill and he or she goes to the Department Of Labor or the IRS for reclassification as a W-2 and be backdated to their start date, the situation just became a nightmare on your desk and liability on your balance sheet.


For smaller employers, converting W-2s to ICs is one way employers look to avoid the ACA mandate because ICs don’t count toward the 50 employee threshold. Because of this, the government is going to look deeper into employers classifying workers, especially employers who move W-2 employees to 1099. In addition to back pay and penalties with misclassification, the ACA mandate penalties can also be assessed once the mandate is enacted in 2015.

Comply or Pay the Price: The Affordable Care Act Employer Mandate

Companies with more than 50 full-time employees working at least 30 hours per week are required to provide ACA compliant health insurance or pay a hefty penalty. Many small businesses are cutting hours and/or cutting positions to keep headcounts below 50. This lends to the obvious issue of preventing company growth, both in revenue and employment. Consider how much your time is worth – how much would it cost your company if you have to handle all that you do, in addition to administering health insurance?
